Real Talk Terms & Conditions

MyHealthEd, Inc. is pleased to provide the Real Talk mobile application (“app”) and related services as a resource for adolescence, sexuality, and health related information for users thirteen years of age and older. By agreeing to these Terms, you agree to comply with the following “Terms of Use.” The “Terms of Use” may be updated or changed at any time. It is important that you periodically review this agreement on the Real Talk website: www.realtalkapp.com. Your continued use implies that you accept any and all changes made to this agreement.

MyHealthEd, Inc. is committed to providing honest, accurate information about adolescence, sexuality, and related health issues. We encourage you to talk about sexuality issues with a trusted adult (parent, counselor, teacher, school nurse, other family member or religious leader).

If you are having a health or psychological emergency, if you are thinking about hurting yourself or someone else or if someone is hurting you, please get help immediately. We do not have the capacity to provide counseling or crisis support, so please contact your parents, guardian, teacher or other trusted adult or call 9-1-1 or the Hope Center Hotline at 1-800-SUICIDE (1-800-784-2433) if you are in the United States. If you are in the United States and an adult is hurting you in any way, you can call the Childhelp National Child Abuse Hotline at 1-800-4-A-CHILD to get connected with assistance. If you are outside of the United States and an adult is hurting you, Child Help International can help you find a local hotline and resources.

The Real Talk app and MyHealthEd, Inc.’s related services are intended only for users thirteen years of age and older.

The information contained within the Real Talk app does not constitute medical, legal or other professional advice. The information presented on this app or sent to you electronically in response to a message from you is meant for general educational purposes only. It is not intended or implied to serve as specific medical advice, diagnosis or treatment. It should never be a substitute for consultation with a physician or other health professional. If you have, or think you might have, a medical problem or symptom, please consult a medical professional right away. To find a family planning clinic or health center near you, look in the yellow pages under “family planning” or call 1-800-230-PLAN for the nearest Planned Parenthood health center.

Also, the information presented on this site or sent to you electronically in response to a message from you does not constitute legal advice. If you have a legal question, always seek the advice of an attorney or other legal professional.

With any information you provide us it is critical that we keep it confidential. When you register and become a member with us, we ask you for your birthdate and gender identity. This information will not be made available to the public at large. Instead, we will use it to make improvements to the app based on the users that visit. We also reserve the right to share this information with third parties with whom we may from time to time contract for any reason.

We also collect your phone number when you register with us. We use this contact information to periodically solicit feedback on the app experience and possible improvements to the app. We will not use your phone number to contact you for any other reason. Nor will we sell or distribute your phone number to anyone else.

MyHealthEd, Inc. does not assume any responsibility or any risk for your use of the Real Talk app or the Internet. The Real Talk app does contain links to other sites, but does not necessarily endorse these sites. MyHealthEd, Inc. does not assume any responsibility or any risk for your use of these sites, their content or privacy practices. Please refer to the individual sites for their “Terms of Use” and/or privacy statements. Once you leave the Real Talk app, you may not have the same privacy or other protections.

MyHealthEd, Inc., assumes no liability for any diagnosis, treatment, decision or action you take in response to the information that is provided online or sent to you electronically in response to a message from you.

In no event shall MyHealthEd, Inc. be liable for any injury, loss, claim, damage, or any incidental or consequential damages arising either directly or indirectly out of or in any way connected with the Real Talk app or any failure or delay in updating or including any materials on the Real Talk app, or any use or inability to use any materials on the Real Talk app, even if MyHealthEd, Inc. has been advised of the possibility of such damages.

The entire Real Talk app is protected by the copyright of MyHealthEd, Inc. All rights reserved. The materials presented on the website may be downloaded and/or printed so long as each copy indicates the appropriate copyright notice and is used only for PERSONAL USE.

Stories on this website are provided expressly for the Real Talk app. They are the property of MyHealthEd, Inc. and cannot be used for any other purposes without the express consent of MyHealthEd, Inc. By submitting a story to MyHealthEd, Inc. or Real Talk, you give us and those third parties with whom we contract a worldwide non-revocable license to use, host, store, reproduce, modify, create derivative works, communicate, publish, publicly display and distribute such content, without qualification.

It is absolutely prohibited to reprint or electronically reproduce any text, document, graphic, photo or audiovisual material for bulk or commercial use. For special copyright permissions, please contact us (see information below).

When you submit a story other material to the Real Talk app, you are authorizing MyHealthEd, Inc. staff to read, edit and publish it in the app or on the website. All questions, comments, articles, etc. submitted to the Real Talk app become the property of MyHealthEd, Inc. to be used in activities related to MyHealthEd, Inc.’s purpose. Reproduction of any story you submit, in whole or in part without permission, is prohibited.

If you submit a story to the Real Talk app, MyHealthEd, Inc. makes no guarantee that it will be published. To find out more about how to submit a story, please click on “Stories” on the Real Talk website to learn more about applying to write. All submissions must be original works.

The MyHealthEd, Inc. staff work very hard to ensure that the information presented on the Real Talk app is accurate. However, MyHealthEd, Inc. disclaims responsibility for any errors or omissions or for unintended technical inaccuracies or typographical errors in the materials.

These terms and conditions shall be governed by and construed in accordance with the laws of the State of North Carolina, USA, and you agree to submit to the personal jurisdiction of the courts of the State of North Carolina in connection with any claims or disputes that may arise from your use of the website. In the event that any portion of these terms and conditions is deemed by a court to be invalid, the remaining provisions shall remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to this website, or the use of this website, must be filed within one year after such claim or cause of action arose and must be filed in a court in North Carolina, USA.
